Terms of service

TERMS OF SALE AND WEBSITE USE

DATE OF LAST UPDATE: 29th September 2026

OVERVIEW

These terms of sale and website use (“Terms”) govern:

  1. your access to and use of this website (“Site”); and
  2. the purchase of goods through the Site.

This Site is operated by Keld & Co Pty Ltd (ACN 656 435 568, ABN 85 656 435 568) (“we”, “us”, “our”).

“You” means any person who accesses or uses the Site, purchases goods or services from us, creates an account, or otherwise uses our goods or services.

By accessing or using the Site, or by purchasing goods from us, you agree to be bound by these Terms, our Privacy Policy, our Shipping and Delivery Policy and our Returns and Exchanges Policy, each of which is incorporated by reference. The Privacy Policy, the Shipping and Delivery Policy and the Returns and Exchanges Policy documents supplement these Terms and should be read together. For further detail on these documents, please access the most up-to-date versions of these documents on our Site. If you do not agree to the Terms and the supplementary documents, do not use the Site.

Our online store is hosted using Shopify Inc.’s e-commerce platform. Checkout, payment and (if you choose to use it) Shop Pay are provided by Shopify and are also governed by Shopify’s own Consumer Terms of Service and Consumer Privacy Policy – see Section 11 below. Shopify is not a party to your purchase contract with us. We remain solely responsible to you for the products you buy from us, including all consumer guarantees described in Section 15.

SECTION 1 - ONLINE STORE TERMS AND ELIGIBILITY

By using the Site, or purchasing goods from us, you represent that you are at least 18 years old, or the age of majority in your country or region of residence (whichever is higher), and have legal capacity to enter into these Terms, or you have given us your consent to allow any of your minor dependents to use this Site.

You must comply with all laws applicable to your use of the Site, including the laws of Australia and of your own country or state of residence (if you are located outside of Australia).

You must not transmit any worms, viruses or any code of a destructive nature.
A serious breach of these Terms may result in suspension or termination of your access to the Site.

SECTION 2 - GENERAL CONDITIONS

We may refuse service for legitimate reasons (for example, suspected fraud, non-payment, or a serious breach of these Terms), which does not affect any right or remedy you have under the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) (“ACL”).

Some content you submit to us (not including payment information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Payment information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Site without our express written permission.

Headings in these Terms are included for convenience only and do not affect interpretation.

SECTION 3 - INTELLECTUAL PROPERTY

Unless otherwise indicated, the Site and all content on it (including text, graphics, logos, product images, product descriptions, videos, software and the layout, "look and feel" and design of the Site) is owned by us (or our licensors) and is protected by copyright, trade mark and other intellectual property laws in Australia and internationally.

You may access and view content on the Site for your own personal, non-commercial use in connection with browsing the Site and purchasing products from us. Except as permitted by law or as expressly authorised by us in writing, you must not reproduce, duplicate, copy, sell, resell, distribute, modify, or otherwise exploit any part of the Site or its content for any commercial purpose.

Nothing in these Terms transfers any intellectual property rights to you, or grants you any licence or right to use our trade marks, trade names, or logos, other than as expressly set out in this section.

If you submit any comments, reviews or other content to us, your rights in that content are addressed in Section 13 (User Comments, Feedback, and Other Submissions).

Except to the extent expressly permitted by law, you must not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying structure, ideas, or algorithms of any product, firmware, software, or App that we supply, nor attempt to circumvent any security or technological protection measure applied to them.

This section does not limit any right you have under the ACL and does not restrict your right to repair or maintain a product you own using ordinary tools and methods.

SECTION 4 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We take reasonable steps to ensure product descriptions, images and specifications on the Site are accurate, but we cannot guarantee that your device’s display will be completely accurate – see Section 6 for further information. Minor variations (such as packaging, colour or minor design changes) may occur between the images shown and the product supplied. This does not affect your right to a remedy under the ACL if a product does not match its description in a way that amounts to a failure to comply with a consumer guarantee.

Material on this Site is provided for general information purposes only and does not constitute advice on which you should rely. We may, but are not obliged to, update, amend, or remove material on the Site at any time without notice.

SECTION 5 - MODIFICATIONS TO THE SITE, PRODUCTS AND PRICES

Prices for products are subject to change, but the price payable for an order you have already placed and paid for will not change. We may modify, suspend or discontinue the Site (or any part or content thereof) at any time. Where reasonably practical, we will give you notice if this materially affects an order you have already placed. This section does not limit any right you have under the ACL in relation to goods you have already purchased.

All prices on the Site are displayed in Australian Dollars (AUD) unless you choose to view the Site in a different currency using a currency selector we may provide. If you do so, the converted price shown is an estimate only, calculated using an exchange rate we do not control and may differ from the rate your bank or card issuer applies when your payment is processed. Any currency conversion, and any difference between the displayed converted price and the amount actually charged, is      at your own risk. We are not responsible for exchange rate fluctuations, or for any conversion or international transaction fees your bank or card provider may charge.

SECTION 6 - PRODUCTS

Product description: We use our best endeavours to ensure that the descriptions, specifications, images and other information about our products (“Product Information”) displayed on the Site are accurate at the time of publication. Product Information may be updated, corrected or amended by us at any time without notice.

Images and representations: Product images are provided to help illustrate the product. Minor variations may occur between the images shown and the product supplied. For example, due to your device’s display settings, photography lighting or minor packaging changes between production batches.

Specifications and performance: Technical specifications (including but not limited to resolution, field of view, night vision range, weatherproofing rating, storage capacity, and wireless connectivity) are based on standard testing conditions provided by us or our manufacturers. Actual performance may vary depending on your specific installation, environment, network conditions and other external factors outside of our control.

Compatibility: It is your responsibility to check that a product is compatible with your intended use, existing equipment, home network and any third-party devices, platforms or services you intend to use it with (including the App), before purchasing. Where compatibility information is provided on the Site, we use our best endeavours to keep it accurate.

Availability and substitution: Products are subject to availability. We will try to notify you as soon as reasonably practicable if a product you have ordered is unavailable and will offer a refund, substitute product (with your agreement), or backorder, at your election. Minor variations to included accessories (such as cabling, mounting hardware or power adapters) may occur between production batches without notice, provided the product remains fit for its intended purpose and continues to correspond with its description in all material respects.

Installation: Unless expressly stated otherwise at the time of purchase, products are supplied for self-installation and are not supplied with professional installation services. Where installation guidance is provided by us (including via instructions, the App, or customer support), it is general guidance only and does not account for the specific structural, electrical or regulatory circumstances of your premises. You are responsible for ensuring installation complies with any applicable building, electrical or safety requirement, and, where relevant, obtaining any necessary permissions (for example, from a landlord or body corporate).

Intended use: Our products are designed to assist with home and premises monitoring and are not a substitute for a monitored security system, fire detection system or emergency response system. You should not rely on a product as your sole means of security or safety monitoring.

Environmental and use-dependent factors: Certain products, or features of a product, may depend on environmental or use conditions outside our control. For example, solar-powered products or accessories rely on adequate sunlight exposure to charge and operate as intended, and will not function correctly, or may have reduced battery life, in low-light, shaded or indoor locations. Similarly, a product’s recording quality, night vision, motion detection, connectivity and other camera functionality may be affected by weather conditions, obstructions, lighting, distance, wireless network strength and the specific location in which it is installed. We make no warranty that a product will perform to a particular standard in your specific environment or installation location, noting that this does not limit your rights under the ACL to a product that is of acceptable quality and reasonably fit for purpose.

Installation requiring a qualified electrician: Installation instructions and standard mounting parts are included with your product, where applicable. However, some installations, including hardwired products or installations involving connection to mains power or existing electrical wiring, must be carried out by a licensed or qualified electrician in accordance with applicable electrical safety laws in your state, territory or country. It is your responsibility to determine whether your installation requires a qualified electrician and to engage one where required. We are not responsible for any loss, damage, injury or voiding of warranty resulting from installation that should have been, but was not, carried out by a qualified electrician.

Compliance with Australian standards: Our products are designed and manufactured to comply with applicable Australian standards, including (where relevant) electrical safety, radiocommunications, and telecommunications standards. If you purchase and use a product outside Australia, it may not comply with the electrical, safety or regulatory standards of your location, may not be compatible with local power supplies, networks or frequencies, and may not be covered by warranty or support in that location. It is your responsibility to check the standards, compatibility and import requirements applicable to your location before purchasing or using a product outside of Australia.

Products purchased through the Site are inclusive of GST, are subject to our Returns and Exchanges Policy and the consumer guarantees described in Section 15.

Please see our Returns and Exchanges Policy for further information: https://keldco.com/pages/returns-exchanges

We may limit the sale of products to any person, geographic region, or quantity, and may discontinue a product at any time, provided this does not affect any order you have already placed and paid for.

SECTION 7 –     MICRO TF CARD STORAGE OF FOOTAGE

Some products record and store footage locally on a compatible Micro TF card (or such other local storage medium as specified in the relevant product documentation).

You acknowledge and agree that:

  1. footage is stored on a Micro TF Card inserted into the product, and it is your sole responsibility to insert, maintain, format, and manage the Micro TF Card in accordance with the product documentation;
  2. Micro TF Cards have a limited storage capacity and finite operational lifespan, and footage may be automatically overwritten, deleted, or lost as a result of storage limits, card failure, corruption, removal, damage, or loss of the Micro TF Card;
  3. it is your responsibility to regularly back up, retrieve, or otherwise preserve any footage you wish to retain; and
  4. to the maximum extent permitted by law, we accept no responsibility or liability for any loss, corruption, inaccessibility, or unavailability of footage stored on the     Micro TF Card.

Unless a product’s listing expressly states otherwise, a Micro TF Card is not included with the product and must be purchased separately if you want to use local card storage. Without a card fitted and without a cloud storage subscription, a product will generally operate in live-view-only mode. Our Privacy Policy describes how local card storage, cloud storage and card-free operation each affect what data we receive.

Nothing in this clause excludes, restricts, or modifies any consumer guarantee, right or remedy that you have under the ACL, or any other applicable law, which cannot be lawfully excluded, restricted, or modified.

SECTION 8 – PRICING AND GST

All prices displayed on the Site are in Australian Dollars (AUD) and, unless otherwise stated, are inclusive of Goods and Services Tax (“GST”) payable under the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

Where GST applies to a supply made under these Terms, the price shown already reflects that GST component, and no additional amount is payable by you on account of GST unless expressly stated at checkout (for example, in respect of shipping or other charges not included in the displayed price).

A tax invoice will be provided with your order (or made available electronically) in accordance with appliable tax law.

If you are located outside Australia, or your order is shipping outside Australia, you may be responsible for import duties, taxes or charges (including any local sales tax, VAT or customs duty) imposed by the destination country, which are not included in the price shown and are payable by you in addition to the price of your order. Please refer to our Shipping and Delivery Policy.

SECTION 9 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We may, at our sole discretion, refuse or cancel any order, in whole or in part, at any time before dispatch or supply, including but not limited to suspected fraud or unauthorised activity, payment issues, pricing or product information errors, or you have breached these Terms. If we cancel your order, we will notify you using the contact details provided. Where payment has been received for an order we cancel, we will provide a refund in accordance with applicable law.

You agree to provide current, complete, and accurate purchase, billing, payment and account information, including but not limited to your email address and credit card numbers, expiration dates and security numbers, and to promptly update it so we can process your order, contact you if required and fulfil our obligations.

Please see our Returns and Exchanges Policy for further information: https://keldco.com/pages/returns-exchanges

SECTION 10 - OPTIONAL TOOLS

Sometimes we may provide you with access to third-party tools or services made by other companies to help improve your experience on our Site, such as tools that display customer reviews and ratings, or live chat services. We call these “optional tools”.

These tools are run by other companies, not by us. We do not check, monitor or approve everything that appears on them, and we cannot guarantee they will always be available or working properly.

Because we do not control these tools, we cannot promise that anything shown through them (like a customer review or star rating) is accurate, complete or up to date. If you rely on this information, you do so at your own risk.

If you use one of these tools, you are also agreeing to that company’s own terms and conditions, which we would encourage you to review prior to use.

We might add, remove or swap out these tools at any time without letting you know in advance. You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties of any kind from us to the extent permitted by law. Your use of any optional third-party tool is at your own discretion and risk.

SECTION 11 – SHOPIFY, CHECKOUT AND SHOP PAY

Our Site is hosted on Shopify. When you check out, and if you choose to use Shop Pay or the Shop app, your use of those specific features is governed by:

https://www.shopify.com/au/legal/terms

https://www.shopify.com/au/legal/privacy/consumers

Shopify has confirmed in its own terms that it is not a party to the purchase agreement between you and us, and is not responsible for fulfilling your order or for the products you purchase. This means, for anything to do with the products themselves (for example, quality, delivery, refunds, and your consumer guarantees), you should contact us using the details in Section 25, not Shopify. For issues specific to the Shop app, Shop Pay, or the checkout technology itself (for example, a payment processing outage), Shopify’s own terms and support channels apply.

Nothing in Shopify’s terms reduces our obligations to you under the ACL for goods you purchase from us.

SECTION 12 - THIRD-PARTY LINKS

The Site may contain links to third-party websites or services not affiliated with us.
We are not responsible for and do not warrant, the content, accuracy or practices of those third parties.  Please review the third party's own terms and policies before transacting with them.

SECTION 13 - USER COMMENTS, FEEDBACK, AND OTHER SUBMISSIONS

If you send us comments, suggestions, or product reviews, you agree that we may use, edit and publish them without compensation to you, provided this is done in a manner consistent with applicable law (including laws on fake or misleading reviews). We may, but are not obliged to, monitor or remove content we reasonably consider unlawful, offensive or in breach of these Terms.

You agree that your comments will not infringe any third party’s rights, and will not be unlawful, defamatory or contain malicious code. You are responsible for the accuracy of your own comments.

SECTION 14 - PERSONAL INFORMATION AND PRIVACY

Your personal information is handled in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APP), and our Privacy Policy:

https://keldco.com/policies/privacy-policy

Where you use Shop Pay, the Shop app, or Shopify’s checkout, Shopify also processes certain personal information as an independent data controller under its own Consumer Privacy Policy (linked in Section 9).

We only use information collected through the Site for the purposes described in our Privacy Policy.

SECTION 15 – GUARANTEES

Any money-back guarantee, satisfaction guarantee, or similar promotional guarantee we may offer on the Site is provided in addition to, and does not replace, limit, or otherwise affect, your rights under the ACL. Any such guarantee is subject to its own specific terms and conditions (including as to eligibility, timeframes and process) – see Returns and Exchanges Policy for further details. We may modify, suspend, or revoke any such promotional guarantee at any time and without notice, provided this does not affect any guarantee that has already been validly claimed, or your right to rely on the guarantee in respect of an order placed while it was still available.

Our goods and services come with guarantees that cannot be excluded under the ACL.

For major failures, you are entitled to a replacement or refund, and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Where we supply a service, that service comes with a guarantee that it will be provided with due care and skill, and (where applicable) is reasonably fit for any purpose you made known to us.

These consumer guarantees apply in addition to, and are not limited by, any warranty we may separately offer, and are not affected by any statement elsewhere in these Terms, our Returns and Exchanges Policy, or our Shipping and Delivery Policy.

To make a claim under a consumer guarantee, please contact us using the details in Section 23.

SECTION 16 - ERRORS, INACCURACIES, AND OMISSIONS

Information on the Site may occasionally contain typographical errors or omissions relating to product descriptions, pricing, promotions, or availability. We reserve the right to correct any error, and to cancel an affected order (with a full refund of amounts paid), except where you have received the goods and the order can reasonably still be honoured. This section does not limit any right you have under the ACL.

SECTION 17 - PROHIBITED USES

In addition to other prohibitions as set forth in these Terms, you must not use the Site:

  1. for any unlawful purpose;
  2. to solicit others to perform unlawful acts;
  3. to violate any applicable law or regulation;
  4. to infringe our or any third party’s intellectual property rights;
  5. to harass, abuse, or discriminate against any person;
  6. to submit false or misleading information;
  7. to transmit viruses or malicious code;
  8. to collect or track others’ personal information without consent;
  9. to spam, phish, pharm, or scrape the Site; or
  10. to interfere with or circumvent the Site’s security features.

We may suspend or terminate your access to the Site for a serious or repeated breach of this section.

SECTION 18 - LIABILITY

Nothing in this section excludes, restricts or modifies your rights under the ACL, including the consumer guarantees described in Section 12.

Subject to the paragraph above, and to the maximum extent permitted by law, we exclude all conditions, warranties and guarantees other than the consumer guarantees, and are not liable for:

  1. indirect, special or consequential loss arising from your use of the Site;
  2. any loss or damage you may suffer as a result of relying on any material contained on our Site;
  3. any loss or damage you may suffer from any data, footage or information that is overwritten, deleted or lost on a Micro TF card (or similar); or
  4. any loss of access to the App.

Nothing in these Terms limits our liability where it is caused by our negligence, fraud, or any other liability that cannot be lawfully limited or excluded.

SECTION 19 – COMPANION APP – NO WARRANTY

The products may be used in conjunction with a companion mobile or web application (the “App”), which may be used to provide functionality such as remote viewing, notifications, and access to footage.

Use of the App is optional and provided as an additional convenience to you. To the maximum extent permitted by law, we provide no warranty or representation, express or implied, in relation to the provision or availability of the App, or your ability to access or continue to access the App.

We may suspend, restrict, terminate, or revoke access to the App at any time and for any reason, without notice, including (without limitation) due to changes to third-party platforms, security or operational reasons, discontinuation of supporting services, or commercial decisions. To the maximum extent permitted by law, we are not liable for any loss, damage, or inconvenience suffered by you as a result of the App, or access to the App, being suspended, restricted, terminated, or revoked for any reason.

Nothing in this clause excludes, restricts, or modifies any consumer guarantee, right or remedy you have under the ACL, or any other applicable law, which cannot lawfully be excluded, restricted or modified.

SECTION 20 – INDEMNITY

To the extent permitted by law, you agree to indemnify us and our officers, employees, contractors and agents against any loss, damage, or reasonable cost (including legal costs) that we incur as a result of your breach of these Terms or your unlawful use of the Site or any breach of any third-party tools or third-party links, except to the extent the loss, damage or cost was caused or contributed to by our negligence, wilful misconduct, or our own breach of these Terms or the ACL.

SECTION 21 – CHANGES TO THESE TERMS

You can review the most current version of the Terms at any time on this Site.

We may amend these Terms from time to time by posting the updated version on the Site, with an updated “Date of Last Update”. If we make a material change, we will provide reasonable notice by email (where available), or by a prominent notice on our Site before the change takes effect. Your continued use of the Site after a change takes effect constitutes acceptance of the updated Terms but does not apply retrospectively to orders already placed.

SECTION 22 - TERMINATION

You may stop using the Site at any time.

We may suspend or terminate your access to the Site, without notice, if we reasonably believe you have seriously or repeatedly breached these Terms, or if required to do so by law.

Termination of your access to the Site does not affect any order you have already placed, or any right you have under the ACL in relation to goods already purchased.

Sections 3 (Intellectual Property), 18 (Liability), 20 (Indemnity), and 24 (Governing Law) survive termination of your access to the Site, along with any other provision which by its nature is intended to survive.

SECTION 23 - SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be severed, and the remaining provisions will continue to apply. These Terms, together with our Privacy Policy, Shipping and Delivery Policy and Returns and Exchanges Policy, form the entire agreement between you and us regarding your use of the Site, superseding any prior agreements or communications on that subject.

Our failure to enforce a right or provision of these Terms is not a waiver of that right or provision.

SECTION 24 - GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia. You and we each submit to the non-exclusive jurisdiction of the courts of Queensland, without limiting either party’s right to bring proceedings in any other court of competent jurisdiction where required by law.

SECTION 25 - CONTACT INFORMATION

If you have any questions, please contact customer service at info@keldco.com or call us (07) 3113 9376.
